Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of ExecReps.ai ("Service"), operated by Product Coalition, Inc., a Delaware corporation ("Company," "we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Description of Service
ExecReps.ai is a voice-based leadership communication training platform. The Service provides AI-powered practice workouts, voice recording and analysis, content and delivery scoring, career pathing recommendations, and team analytics.
Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
Payment and Billing
Free Pilot
New teams may start with a free 14-day pilot that includes up to 5 seats. The pilot provides full access to platform features so your team can evaluate the Service before committing to a paid plan.
Teams may purchase a paid plan at any point from Day 1 through the end of the pilot period.
Annual Plans
All paid plans are billed annually. We offer the following tiers:
- Small Team: $5,000/year (10 seats)
- Starter: $10,000/year (25 seats)
- Growth: $35,000/year (100 seats)
- Enterprise: Custom pricing for 250+ seats. Contact sales for details.
Current pricing is available on our Pricing page. Pricing is subject to change with 30 days advance notice.
Auto-Renewal and Cancellation
Paid plans automatically renew at the end of each annual billing cycle. To cancel auto-renewal, you must provide written notice at least 30 days before the end of your current billing period.
Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
Upgrades and Seat Changes
You may upgrade your plan or add seats at any time. Upgrades are prorated for the remainder of your current billing cycle and invoiced immediately. Seat reductions take effect at the next renewal date.
Acceptable Use
You agree to use the Service only for its intended purpose of professional communication training. You may not:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Upload content that is harmful, offensive, or infringes on the rights of others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers connected to the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to build a competing product or service
- Share account credentials with unauthorized users
Intellectual Property
The Service, including all content, features, and functionality, is owned by Product Coalition, Inc. and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all voice recordings and content you submit through the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service, including transcription, analysis, and scoring.
AI-Generated Content
The Service uses artificial intelligence to generate feedback, scores, and recommendations. AI-generated content is provided for informational and training purposes only and should not be considered professional advice.
We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You acknowledge that AI outputs may occasionally contain errors or inconsistencies.
Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.
Limitation of Liability
To the maximum extent permitted by law, Product Coalition, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Indemnification
You agree to indemnify, defend, and hold harmless Product Coalition, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions. Any legal proceedings arising from these Terms shall be brought exclusively in the courts of the State of Delaware.
Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.
If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Wilmington, Delaware. The arbitrator's decision shall be final and binding.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Product Coalition, Inc. regarding the Service. These Terms supersede all prior agreements, communications, and understandings, whether written or oral.
Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or cyberattacks.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date.
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
